The California 3 Day Notice to Quit Incurable is issued when the tenant has breached certain terms contained in the agreement in a way which cannot be undone [ Calif. Code of Civil Procedure §1161(4) ]. If the tenant has failed to vacate the premises after 3 days of serving this notice, legal proceedings may be initiated against the tenant to recover any damages, rent owed and attorney charges. This Notice can be provided to both residential and non-residential tenants.
How to Write
Date & Address of the landlord:
Enter the issued date of this notice and also mention the Landlord’s complete address.
Name of the tenant:
Mention the complete name of the tenant as per the lease agreement.
Filling the Facts:
1.1 – Enter the date when the lease agreement expired and address in California where it was executed
1.2 – Mention the name of Landlord & Tenant as is mentioned in the lease agreement entered between the parties
1.3 – Give the type of property it is, commercial or residential.

3. The tenant has to handover the possession of the property within 3 days of this notice to the Landlord or his representative who has also served this notice.

Final Step
This notice doesn’t mean anything until it’s properly served on everyone you want to evict. This can be served in various modes to the tenant, either by hand delivery or sent by mail. One has to be over 18 to serve this notice. The Judicial Council of California shall adopt rules, not inconsistent with statute, prescribing the time for filing and serving opposition and reply papers.
