A Illinois 5 Day Notice to Quit Form for Unlawful Activity notice can be issued to the tenant when the landlord notices illegal activities taking place in the premises under possession by the tenant in the State of Illinois.
Illegal activities involve trading of illegal drugs or any other illegal substances within the premises,if the landlord finds any evidence of such activities he may issue a 5 Day Notice to Quit Form to the tenant. How to Write a Illinois 5 Day Eviction Notice
The steps on how to write or prepare the form as per the eviction notice template available on this site is as follows
- Name of the County
Mention in which County the property is situated.
- Addresses
On the left hand side, fill in the complete address of Landlord along with ZIP code. And on the right hand side you have to address the tenant who is in possession of the property.
- Select the unlawful activity
Option one is to be selected if the tenant has involved in unlawful activity related to possession, distribution, etc. of controlled substance (like Drugs). Or any unlawful activity under the law code: 740 ILCS 40/11.
Option two is to be selected if the tenant has committed a Class X Felony under the law code 765 ILCS 705/5. Also provide the details of the property under possession and the number of the apartment/flat/door no. etc. Mention to whom the property is to be handed over within the notice period.
- Date of Notice
Enter the date when the notice is issued to the tenant.
- Signature
If the Landlord is issuing this notice, then his/her signature should be provided. If any agent is appointed for this purpose, then the agent’s name & signature is to be provided.
Affidavit of Service
Fill in this section after delivering the notice to tenant. Mention the name of the County where the property under possession by tenant is situated.
Name of the person who has delivered the notice and also mention the method in which the notice was issued. If it was issued in person to the tenant or a copy of the notice was left at the premises or this notice was affixed on the premises in the absence of the tenant.
Enter the date when the notice was issued. Also a Notary Public has to attest this document.
Final Step
Any property eviction (related to unlawful activity on the premises) in the Illinois eviction process begins with service of a written notice on the tenant as per the Illinois Compiled Statutes (740 ILCS 40/11) (from Ch. 100 1/2, par. 24). The notice period begins on the day the tenant receives the notice with weekends excluded in counting the notice period.
The notice can be given to the tenant either by personally delivering the copy, leaving the copy or pasting a copy at the door if the tenant was not available at the time of delivery.
