The Affidavit for Collection of Personal Property of Decent is regulated in the State of Alaska under the Alaska Statues; Sec. 13.06.050., Sec. 13.16.680., Sec. 13.16.685., Sec. 28.10.011.
This form is the collection of certain personal belongings from the person who recently died. An affidavit is a written statement (confirmed by oath, declaration or affirmation) to confirm that the correct person is collecting the belongings.
The affidavit enables the people who are entitled to the dead person’s (decedent’s) Personal Property. Person Property includes the decedents belongs, like a vehicle, but does NOT include their Real Property such as a house or land.
This Affidavit will entitle you to payments of all money that is owed to the decedent and provide you legal claim to all of their tangible personal belongings. The maximum limits are as follows; vehicles with a total value of $100,000 or more and all other personal property valuing above $50,000 are NOT considered Personal Property and are dealt with outside of this Affidavit.
When is the right time for this Affidavit?
This type of Affidavit can only be used 30 Days since the death of the decedent.
How to Write
- Box 1. Below the title of the form, please complete your full name in full, including any middle name.
- Box 2,3,4. You are required you to fill in the decedent’s full name, the date and year they passed away.
- Box 5. Further down within Section 1, you must state the basis upon which you claim to be successor, you should write here as to why you are entitled to the property. (i.e. your family tie)
- Box 6. You should sign your signature here.
- Box 7. Enter your Mailing Address where you are readily available to receive letters in the mail by post.
- Box 8. Fill in your City, State and ZIP
- Box 9. Fill in your full Telephone Number
Things to Remember
- You will need to check the vehicle’s registration (For more details on this matter please visit http://doa.alaska.gov/dmv/)
- You cannot use this Affidavit if there is an application or petition for a personal representative of the decedent’s estate. (Pending or Granted) A personal representative is someone who has been officially named / given the legal power to handle the decedent’s estate.
